Abstract

The consultation launched by the European Commission on the review of Directive (EU) 2019/790 and on a possible targeted initiative in the field of copyright offers an opportunity to reflect on the relationship between Open Science, artificial intelligence and knowledge infrastructures. This article analyses the issues that emerged from discussions at European, transnational, national and institutional levels, with particular attention to the secondary publication right, research exceptions, text and data mining, and the scientific use of content in AI systems. It argues that a reform consistent with Open Science cannot be limited to the regulation of markets and licences, but must recognise the role of universities, libraries, repositories, university presses and research support services in the production, preservation, circulation and reuse of knowledge. This requires university strategies capable of integrating open access, bibliodiversity, responsible research assessment, research data management and reliable infrastructures.
